Request for postponement of hearing
This service is intended for individuals who, for a serious reason, are unable to appear in court on the date and at the time indicated on the notice of hearing.
In the event that the defendant does not appear at his hearing, a default judgment will be rendered against him at this hearing. According to section 188 of the Code of Penal Procedure, when the defendant on whom a statement of offense has been duly served is deemed to have submitted a plea of not guilty, the prosecution is heard and judgment is rendered even if the defendant is absent. In order to avoid such a judgment, it is important to submit a request for a postponement of the hearing to the judge. The reasons invoked in this request must be serious.
